Deepak KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to bond and surety conditions, under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.

Summary

The petitioner, Deepak Kumar, feared arrest in a case involving the recovery of 460.515 litres of liquor from a vacant land, alleged under Section 30(a) of the Bihar Prohibition and Excise Act. The prosecution’s case is based on the recovery of the liquor, while the petitioner claims he was falsely implicated solely on a co-accused’s confessional statement and has no knowledge of the incident. He also argued that the liquor was recovered from an open public place, he has no criminal antecedent, and there was no compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed the bail. The Court, considering the circumstances, granted anticipatory bail subject to a bond of Rs. 15,000 and two sureties, under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances.
  • Whether there is a prima facie case against the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the requirements of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023 have been complied with.
