Patna High Court

Pintu Kumar @ Maigar YadavversusThe State of Bihar

Holding

The court granted provisional anticipatory bail to the petitioner subject to bail bond and sureties, with confirmation contingent upon verification of his criminal antecedents.

Summary

The petitioner, Pintu Kumar, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2022 for alleged recovery of 82 litres of liquor from a bush adjacent to his house. He has nine prior criminal cases, six of which are under the Excise Act, and argues that the liquor was not found in his possession and that the complaint originated from a chowkidar rather than a proper police investigation. He sought anticipatory bail, contending that the prosecution’s case is weak and that his antecedents should be examined before any bail decision. The court, after hearing both sides, granted provisional anticipatory bail conditioned on a bail bond of Rs.45,000 and two sureties of the same amount, subject to verification of his criminal antecedents. The order directs that if the petitioner is found to have more than nine prior cases, the bail will not be confirmed; otherwise, it will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of anticipatory bail.
  • Whether the absence of recovered liquor in the petitioner’s possession justifies anticipatory bail.
  • Whether verification of the petitioner’s criminal antecedents is required before confirming bail.

3 06-04-2026 1. Heard learned counsel for the petitioner and learned

                   A.P.P. for the State.

                                2. The petitioner apprehends his arrest in a case

                                3. Learned counsel for the petitioner submits that

petitioner has antecedent of nine cases, out of which, six cases

are under the Excise Act and allegation is of recovery of 82

litres of liquor from a bush near the house of the petitioner. It is

next submitted that petitioner was not arrested from the spot as

such nothing was recovered from his conscious possession and

even alleged recovery is from a place which does not belong to

the petitioner but then is adjacent to his house and he came to be

of the involvement of the petitioner in the occurrence then why

he did not inform the police prior to institution of the instant

FIR which casts an aspersion on the case of the prosecution. It is

next submitted that once an accused is implicated in a case

relating to excise, the police starts implicating mechanically

either through chowkidar, local person, confessional statement

or secret information without holding a proper investigation.

                       4. Learned A.P.P. for the State opposes the prayer for

counsel for the petitioner, the petitioner above-named, in the

event of his arrest or surrender within a period of six weeks

from today, be released on provisional anticipatory bail on
