Patna High Court

Feku YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner subject to specified conditions.

Summary

The petitioner, Feku Yadav, a driver, was arrested in connection with a case alleging that 3452.4 litres of liquor were recovered from a truck tanker, violating Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act. He claimed he was falsely implicated, had no ownership of the vehicle, and no incriminating article was found in his possession; he also asserted that Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, had not been complied with. The State opposed bail, but the court considered the lack of direct evidence against the driver, his clean record, and the period of custody already served. Weighing these factors, the court decided to grant bail, subject to a bond of Rs.15,000 with two sureties and conditions regarding appearance and non‑tampering with evidence. The order directs release after framing of charge, if not already done.

Issues considered

  • Whether the petitioner is entitled to bail despite the alleged offences under the Bihar Prohibition and Excise Act.
  • Whether the procedural requirement of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, has been complied with.
