Patna High Court

Jugal Kumar BaithaversusThe State of Bihar

Decided

DISPOSED

Holding

The Court granted provisional anticipatory bail, subject to verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Jugal Kumar Baitha, was implicated in a case under Sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act for the alleged recovery of 200 litres of liquor from two motorcycles and an auto. He contended that he had no conscious possession of the liquor and was only the owner of the auto, asserting a clean antecedent. The State opposed his application for anticipatory bail. The High Court considered the submissions and the lack of direct possession, and ordered provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties. The order conditioned confirmation of bail on verification of the petitioner’s criminal antecedent by the trial court. If any antecedent is found, the provisional bail would be withdrawn; otherwise, it would be confirmed.

Issues considered

  • Whether anticipatory bail should be granted when the accused is not in direct possession of the contraband but is the owner of the vehicle used.
  • Whether the petitioner’s claim of a clean criminal antecedent affects the grant of anticipatory bail.

was recovered from his conscious possession. It is further

that no prudent person would use his own vehicle for

committing an occurrence and, thus, would create evidence

against himself and, hence, would get implicated. It is also

learned Trial Court shall verify the criminal antecedent of

the petitioner and if it is found that petitioner has antecedent
