The Court ordered provisional anticipatory bail subject to verification of the petitioner’s antecedents and compliance with the stipulated conditions.

Summary

Shivnath Sahani applied for anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, alleging recovery of 35 litres of liquor and 3000 kg of semi‑prepared liquor from a public riverbank. He asserted a clean criminal record and argued that the seized liquor was not in his possession nor on his private property, contending that the police relied on secret information to implicate him. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.500 with two sureties and that the trial court verify his antecedents. If any prior case is discovered, the bail will not be confirmed; if his clean record is confirmed, the bail will be made permanent.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.
  • Whether the petitioner’s alleged involvement and lack of possession justify denial of bail.

implicated based on secret information which is the easiest way

to implicate someone without holding a proper investigation,

when petitioner admittedly is a person with clean antecedent. It

is also submitted that at times, the police in order to save the

real culprit tried to implicate innocent people.

                       6. It is made clear that the learned trial court thereafter

shall verify the criminal antecedents of the petitioner and in the

event if it is found that petitioner has antecedent of even one

case, in that event, it would be presumed that petitioner had

concealed his antecedent before this court, as such, the
