Patna High Court

Md. SirajversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to monetary bond and specified conditions.

Summary

The petitioner, Md. Siraj, a driver of a Scorpio vehicle, was arrested on 10 January 2026 for alleged possession of 179.250 litres of liquor, contravening Sections 292 and 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 30(a), 32, 41(i) & (ii) of the Bihar Prohibition and Excise Act. The petitioner claimed he had no knowledge of the liquor, that no incriminating material was found on his person, and that he had no prior criminal record. The State opposed bail, arguing the seriousness of the offence. The Court considered the lack of direct evidence against the petitioner, his clean record, and the period of custody already served, and decided to grant bail. Bail was ordered on a bond of Rs. 15,000 with two sureties, subject to conditions of personal surety, regular court attendance, and non‑interference with evidence or witnesses.

Issues considered

  • Whether bail should be granted to the accused in a case of alleged possession of liquor under the Bharatiya Nyaya Sanhita, 2023 and the Bihar Prohibition and Excise Act.
  • Whether the absence of direct incriminating material on the accused and his clean criminal record justify bail despite the seriousness of the offence.
