The Court granted a further six‑week extension for the petitioner to furnish bail bonds, modifying the earlier order.

Summary

Petitioner Tetar Kumar was granted anticipatory bail on 7 October 2025 in Criminal Miscellaneous No. 70630 of 2025. He failed to appear before the court and furnish the required bail bonds within the six‑week period because he was out of state and only returned on 23 December 2025. On 18 March 2026, he filed an application seeking a further six‑week extension to furnish the bail bonds, asserting no intention to defy the court’s order. The Additional Public Prosecutor representing the State raised no objection. The High Court, after considering the circumstances, extended the time for furnishing bail bonds by another six weeks, modified the earlier order accordingly, and allowed the modification application.

Issues considered

  • What is the appropriate procedure for extending the time to furnish bail bonds after an anticipatory bail order?
  • Whether the petitioner’s absence from the state and lack of intent to flout the order justify granting an additional extension.
