The court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedent and compliance with the stipulated conditions.
Summary
Petitioner Pawan Mahto, a person with a clean antecedent, was implicated in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of five litres of liquor from a location behind his house. He feared arrest as the alleged liquor was not found in his possession and the informant’s identity was omitted from the FIR. The petitioner sought anticipatory bail, arguing lack of direct involvement and his clean record. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and directed verification of the petitioner’s antecedent, with confirmation of bail contingent on a clean record.
Issues considered
- Whether anticipatory bail can be granted to the petitioner under Section 482(2) of the BNSS in a case under Section 30(a) of the Bihar Excise Act.
- Whether the absence of possession and the omission of the informant’s name in the FIR justify granting anticipatory bail.
