Patna High Court

Vishal Kumar Rebal @ Vishal Kumar GaundversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The modification application is dismissed, and the anticipatory bail order remains in force.

Summary

Vishal Kumar Rebal, the petitioner, had earlier been granted anticipatory bail by the High Court. The State of Bihar filed a modification application alleging that the bail was obtained by concealing the petitioner’s criminal antecedents. The petitioner was represented by Mr. Ram Niwas Ray, while the State was represented by Mr. Akshay Lal Pandit. Justice Satyavrat Verma observed that the court should not modify an anticipatory bail order merely on the ground of concealment of past offences. Consequently, the application to modify the bail was dismissed, leaving the original anticipatory bail order intact.

Issues considered

                              2. The Court is taking a consistent view of not

modifying the order by which petitioner was granted

anticipatory bail, in the event, if the same was obtained by

concealing the criminal antecedent of the petitioner.

                              3. Accordingly, the instant modification application is

                    dismissed.
