Patna High Court

Angad KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to specified conditions.

Summary

Angad Kumar was arrested on 24‑12‑2025 in connection with FIR No. 230/2025 alleging assault on an informant and other offences under Sections 191(2), 190, 115(2), 109, 352 and 351(2) of the B.N.S., 2023. He filed a bail petition, claiming a clean criminal record and that the allegations against him were fabricated, with the primary assault charge directed at co‑accused Vicky Kumar. The State opposed the bail. The Court examined the FIR, noted the absence of a specific allegation against the petitioner and his clean antecedent, and concluded that bail could be granted. Accordingly, the petitioner was released on bail upon furnishing a Rs.10,000 bond with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence or witnesses, and verification of antecedents. The order also empowered the lower court to cancel bail if conditions were breached.

Issues considered

  • Whether the petitioner is sufficiently implicated in the offences to warrant denial of bail
  • Whether the petitioner’s clean antecedent and lack of specific allegation in the FIR justify granting bail
  • Whether the conditions imposed are appropriate to safeguard the trial process
