Patna High Court

Zarina Ansari @ Zarina BegumversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a Rs.10,000 bond, two sureties and compliance with section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

The petitioner, Zarina Ansari, filed a bail petition fearing arrest in a case registered under sections 126(2), 118(2), 109(1), 103(1) and 3(5) of the Bharatiya Nagarik Suraksha Sanhita (BNS). The prosecution alleged that on 20 July 2025 the accused, including the petitioner’s son‑in‑law, assaulted the informant’s husband with a knife, while the specific stabbing was attributed to co‑accused Md. Soni Ansari and Md. Sikandar Ansari. The petitioner, a woman with a clean antecedent, argued that she had no role in the alleged offence and sought bail. The State opposed the bail on the ground of the seriousness of the charges. Considering the petitioner’s clean record, the nature of the allegations, and the statutory provisions, the Court granted bail on a bond of Rs.10,000 with two sureties, subject to conditions under section 482(2) of the BNS. The bail order was made with the direction that the petitioner surrender within eight weeks if arrested.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious offences alleged under the BNS.
  • Whether the petitioner’s clean antecedent and lack of direct involvement justify bail.
  • Whether the conditions prescribed under section 482(2) of the BNS are applicable.
