Patna High Court

Guddu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted as there is no specific allegation of assault against the petitioner and he has a clean antecedent.

Summary

Guddu Kumar was arrested on 28-12-2025 in connection with a case involving multiple offences under the B.N.S., 2023, alleged to have helped release an apprehended co-accused. The petitioner pleaded that he has a clean antecedent and that the FIR contains only a general allegation against all accused, with no specific charge of assault or overt act against him. The State opposed bail, but the court noted the absence of specific allegations and the petitioner's clean record. Consequently, the court granted bail on a bond of Rs. 10,000 with two sureties, subject to conditions of cooperation, non‑tampering with evidence or witnesses, and verification of antecedents. The bail order also stipulated cancellation if the petitioner fails to appear on two consecutive dates without sufficient reason.

Issues considered

  • Whether bail should be granted to the petitioner given the nature of the charges and lack of specific allegation of assault
  • Whether the petitioner's clean antecedent warrants bail despite the serious offences listed
