Provisional anticipatory bail is granted to the petitioner subject to conditions under Section 482(2) of the BNSS.

Summary

The petitioner, Sonu Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act for alleged recovery of 61.200 litres of liquor from a ditch adjacent to his house. He asserted a clean criminal record and argued that the allegation was based solely on a confessional statement made by his brother, Pappu Kumar, while in police custody, which the petitioner contended lacked evidentiary value. The State opposed the bail, but the court noted the absence of any seized liquor in the petitioner’s possession and the questionable reliability of the brother’s statement. Consequently, the court granted provisional anticipatory bail, subject to a modest bond, two sureties, and verification of the petitioner’s antecedent by the trial court. The order stipulated that if any prior case is discovered, the bail would be revoked, whereas confirmation would follow if the petitioner’s clean record is verified.

Issues considered

  • What is the appropriateness of granting anticipatory bail to the petitioner under the circumstances of the case?
  • Does the confessional statement of the petitioner’s brother, made in police custody, constitute sufficient basis for arrest?
  • Are the conditions imposed under Section 482(2) of the BNSS valid for provisional anticipatory bail?
