Patna High Court

Raushan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioners.

Summary

The petitioners, Raushan Kumar and Amit Kumar Thakur, were passengers on a bus from which 72 litres of foreign liquor was seized, leading to charges under Section 30(a) of the Bihar Prohibition and Excise Act. They contended that they had no knowledge of the contraband, no incriminating material was found on them, and they possessed clean criminal records. The State opposed bail, but the court noted the petitioners had been in custody since 10‑11‑2025 and that Section 103 of the BNSS, 2023 had not been complied with. Considering these circumstances, the court deemed the bail application justified. Consequently, the court ordered their release on bail with a bond of Rs.15,000 and two sureties of equal amount.
