Patna High Court

Sunil AhirwarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond and specified conditions.

Summary

Sunil Ahirwar was arrested on 8 January 2026 in connection with a case involving the seizure of 353.55 litres of foreign liquor, alleged to violate Sections 30(a), 32(1) and 41(1) of the Bihar Prohibition and Excise Act, 2018. The petitioner argued that he has a clean criminal record, that the liquor was recovered from a pick‑up van and not from his conscious possession, and that the investigating authorities failed to comply with Sections 103 and 105 of the Bihar Narcotic Substances Act (BNSS). The State opposed bail. The High Court, noting the petitioner’s clean antecedent and the procedural lapses, granted bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of antecedents. The order also empowered the lower court to cancel bail for non‑compliance with the conditions.

Issues considered

  • Whether bail should be granted to the accused in a case under the Bihar Prohibition and Excise Act involving large quantity of foreign liquor.
  • Whether the alleged non‑compliance with Sections 103 and 105 of the BNSS warrants the grant of bail.
  • Whether the fact that the seized liquor was not in the accused’s conscious possession affects the bail decision.
