BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to a bail bond and sureties under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.

Summary

Sonu Yadav sought anticipatory bail fearing arrest in an excise case where 233.280 litres of liquor were seized from his vehicle. He contended that he was falsely implicated, had no knowledge of the goods, and possessed no criminal antecedent, also highlighting non‑compliance of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed the bail. The Court examined the prima facie case and the statutory provisions, and, applying Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023, ordered that the petitioner be released on anticipatory bail upon furnishing a bail bond of Rs. 15,000 and two sureties of equal amount, subject to the conditions laid down. The order was conditioned on the petitioner surrendering before the lower court within six weeks.
