DISPOSED

Holding

The Court provisionally granted anticipatory bail subject to verification of the petitioner’s criminal antecedent and compliance with the stipulated conditions.

Summary

The petitioner, Ritik Yadav, sought anticipatory bail after learning that he might be arrested in a case under Section 30(a) of the Bihar Excise Act concerning the alleged seizure of 538.920 litres of liquor from a Scorpio vehicle. He contended that he was not in possession of the liquor, was not the owner of the vehicle, and was implicated by a hostile chowkidar. The State opposed the bail, arguing the seriousness of the offence. The Court granted provisional anticipatory bail conditioned on a bail bond of Rs.10,000 with two sureties and directed the trial court to verify the petitioner’s criminal antecedent within six weeks. It further held that if more than two prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under Section 482(2) of the BNSS in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the petitioner’s alleged antecedent of two prior excise cases affects the grant of anticipatory bail.

  • excise law
  • Section 30
  • Bihar Excise Act
  • Section 482
  • criminal antecedent

is next submitted that if Chowkidar was aware of the

involvement of the petitioner in the occurrence then why he did

not inform the police prior to institution of the instant FIR
