The Court granted provisional anticipatory bail subject to bond, sureties and verification of antecedent, with confirmation only if the petitioner has at most one prior case.

Summary

The petitioner, Rajnish Kumar, feared arrest in a case under Sections 30(a), 30(c) and 30(d) of the Bihar Excise Act alleging recovery of liquor from two locations. He argued that he was not caught in the act, no liquor was seized from his possession, and the FIR did not disclose the informant, casting doubt on the prosecution’s case. The State opposed his prayer for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on a bond of Rs.5,000 with two sureties, subject to verification of the petitioner’s criminal antecedent. It directed that if the petitioner is found to have more than one prior case, the bail would not be confirmed; if only one prior case is found, the provisional bail would be confirmed. The order was made under Section 482(2) of the Code of Criminal Procedure.

Issues considered

  • Whether anticipatory bail should be granted in a case under Sections 30(a), 30(c) and 30(d) of the Bihar Excise Act.
  • Whether the absence of seizure from the petitioner’s possession and the non‑disclosure of the informant in the FIR affect the grant of anticipatory bail.
  • Whether provisional anticipatory bail can be conditioned on verification of the petitioner’s criminal antecedent.
