The court granted bail to the petitioner.

Summary

The petitioner, Vikesh Kumar, was arrested in connection with a case (Muffasil P.S. No. 668 of 2025) alleging offences under Sections 310(2) and 311 of the B.N.S., 2023, wherein unknown assailants allegedly robbed an informant at gunpoint. The petitioner contended that he was falsely implicated, that the FIR named unknown miscreants, and that the only evidence against him was the victim's confessional statement in a related case, with no material recovery or TIP conducted. The State opposed bail, highlighting the petitioner's alleged criminal antecedents in three other cases. The court examined the lack of substantive evidence linking the petitioner to the crime and considered his prolonged judicial custody since 27‑11‑2025. Weighing the circumstances, the court found no sufficient ground to deny bail. Consequently, the petitioner was ordered to be released on bail upon furnishing a bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner in the absence of material evidence linking him to the alleged offences under Sections 310(2) and 311 of the B.N.S., 2023.
