Provisional anticipatory bail is granted subject to conditions and verification of criminal antecedents under Section 482(2) of the BNSS.

Summary

The petitioners, Tunnu Sahni and Golu Sahni, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act concerning the alleged recovery of 560 litres of liquor from two boats. They argued they were not caught in possession, the FIR did not name the informant, and they had no or minimal criminal antecedent. The State opposed the bail. The Court granted provisional anticipatory bail, requiring each petitioner to furnish a bail bond of Rs.5,000 with two sureties, subject to verification of their criminal records by the trial court under Section 482(2) of the BNSS. If any petitioner is found to have concealed antecedents, the bail will not be confirmed for that individual. Upon verification showing clean records, the provisional bail will be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 30(a) of the Bihar Excise Act.
  • Whether the petitioners' criminal antecedents warrant denial of anticipatory bail.

2 19-03-2026 1. Heard learned counsel for the petitioners and

                   learned A.P.P. for the State.

                             2. The petitioners apprehend their arrest in a case

registered for the offences punishable under Section 30(a) of the

                   Bihar Excise Act.

                             3. Learned counsel for the petitioners submits that

petitioner no. 1 is a person with clean antecedent and petitioner

no. 2 has antecedent of one case and allegation is of recovery of

560 litres of liquor from two boats.

                             4. Learned counsel for the petitioners submits that the

petitioners were not arrested from the spot as such nothing was

instance of local people, but then the name of the person, who

disclosed the name of the petitioners is not disclosed in the FIR,

which casts an aspersion on the case of the prosecution, when

petitioners have not been implicated based on secret

          information.

                   5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioners.

                   6. Considering the submissions made by the learned

counsel for the petitioners, the petitioners above-named, in the

event of their arrest or surrender within a period of six weeks

from today, be released on provisional anticipatory bail on

                   7. It is made clear that thereafter the learned Trial Court

shall verify the criminal antecedent of the petitioners and in the

event if it is found that petitioner no. 1 has antecedent of even
