The court granted anticipatory bail to the petitioner subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Summary
The petitioner, Ranjeet Singh, applied for anticipatory bail fearing arrest in a case (PS Case No. 194 of 2025) involving alleged extortion of Rs.10 lakh and a firing incident, though no one was injured. The prosecution alleged his participation in demanding the money and that a co‑accused, Dhanraj Kumar, fired a gun. The petitioner contended he was falsely implicated, had no criminal antecedent, and highlighted that Dhanraj Kumar had already been granted anticipatory bail in a similar case. The State opposed the bail, citing the seriousness of the offences listed under the Bharatiya Nagarik Suraksha Sanhita, 2023 and the Arms Act. After hearing both sides, the court ordered that the petitioner be granted anticipatory bail, directing him to surrender within four weeks and to furnish a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 in view of the alleged offences.
- Whether the seriousness of the alleged extortion and firing offences precludes the grant of anticipatory bail.
