Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to the conditions imposed under Section 482(2) of the Code of Criminal Procedure.

Summary

Laddu Kumar applied for anticipatory bail after being implicated in a case alleging kidnapping, rape, and related offences under Sections 366, 376, 506 and 34 of the IPC and Section 67 of the IT Act. The petitioner asserted that he has a clean record, that the allegations are false, and that he and the alleged victim were in a consensual relationship that resulted in marriage and a child. The informant, who lodged the complaint, did not oppose the bail application. The court considered the petitioner's claim of false implication, his willingness to furnish bail bonds and sureties, and the statutory power under Section 482(2) of the Code of Criminal Procedure. The court held that anticipatory bail should be granted subject to the stipulated conditions. Consequently, the anticipatory bail application was allowed.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner in view of the pending charges under the IPC and IT Act
  • Whether the petitioner’s claim of false implication and clean antecedent justify the grant of bail
