BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to specified conditions.

Summary

Golu Kumar, the petitioner, was named in a FIR (Madhuban PS Case No. 465 of 2025) for alleged offences under several sections of the Bharatiya Nyaya Sanhita, including assault with a knife and robbery. The informant claimed the petitioner struck him with a knife and stole his ornaments, while the petitioner contended there was a case‑counter‑case and that his own injury was simple. The learned Sessions Judge observed that the injury to the informant was simple and that the petitioner had no prior criminal record. Relying on these findings, the High Court considered the petition for anticipatory bail under Section 438(2) of the Criminal Procedure Code. The Court granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to comply with a series of conditions, including regular appearances before the police and trial court and refraining from tampering with evidence.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438(2) of the Cr.P.C. in view of the nature of the alleged offences and the simplicity of the injury.
