BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners subject to the conditions prescribed under Section 438(2) Cr.P.C. and Section 482(2) B.N.S.S.

Summary

The petitioners, four brothers from Jhauwa village, sought anticipatory bail fearing arrest in a case registered under Sections 115(2), 126(2), 109(1) and 3(5) of the Bihar Narcotic Substances Act, 2023. They contended they have clean antecedents and were falsely implicated by an informant who alleged an assault on 19‑12‑2025, but offered no specific motive or detailed evidence. The State opposed the bail, arguing the seriousness of the offences. The Court examined the lack of concrete evidence and the petitioners’ clean record, and applied the provisions of Section 438(2) of the Criminal Procedure Code and Section 482(2) of the B.N.S.S. The Court granted anticipatory bail, subject to a bail bond of Rs.10,000 with two sureties and compliance with conditions laid down by the trial court.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 Cr.P.C. in a case involving alleged offences under the B.N.S. Act, 2023.
  • Whether the allegations made by the informant constitute sufficient ground to deny bail.
