Patna High Court

Atal KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner.

Summary

The petitioner, Atal Kumar, was arrested on 22 November 2025 in connection with a police case (Bhagwanpur PS Case No. 316 of 2025) alleging assault on police officers while they were seizing illicit liquor. He was charged under multiple sections of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act. The petitioner contended that he was falsely implicated, arguing that the FIR only mentioned a lathi in his hand and that the specific assault allegation was directed at co‑accused who had already been granted bail. The State opposed the bail application, citing the seriousness of the offences. After hearing both sides, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs. 10,000 with two sureties and required his attendance at the police station every Sunday, with bail cancellation for non‑compliance.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious charges under the Bharatiya Nyaya Sanhita and the Arms Act
  • Whether the allegations in the FIR sufficiently link the petitioner to the assault on police officers
