Patna High Court

Imran @ Syed Imran NobiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to anticipatory bail, subject to the conditions prescribed under Section 438(2) of the Criminal Procedure Code.

Summary

The petitioner, Imran Nobi, sought anticipatory bail fearing arrest in a case involving multiple IPC offences and the Prevention of Damage to Public Property Act. He argued that his two prior cases pertained to the same offence as the present FIR and cited a similar anticipatory bail order granted to Md. Taslim and Md. Suddu in Cr. Misc. No.52743 of 2024. The State opposed the bail. The court, after considering the submissions and the earlier order, granted anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.10,000 with two sureties of equal amount, subject to the conditions of Section 438(2) of the CrPC. The order is effective for six weeks from the date of the order, pending surrender or arrest. The petitioner was directed to comply with the bail conditions before the trial court.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 of the CrPC despite the seriousness of the offences alleged.
  • Whether the prior anticipatory bail order in Cr. Misc. No.52743 of 2024 is applicable as a precedent to the present case.
