Holding
The Court provisionally granted anticipatory bail to the petitioner, subject to bond, sureties and verification of his criminal antecedents.
Summary
The petitioner, Vidayanand Yadav, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, alleging recovery of 54 litres of liquor from a pick‑up vehicle. He argued that he was not in actual possession of the liquor, was not the owner of the vehicle, and that the only evidence against him was a confessional statement made by another person in police custody, which he claimed lacked evidentiary value. The State opposed the bail, contending that the offence warranted detention. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs 5,000 with two sureties and directed verification of the petitioner’s criminal antecedents within six weeks. If more than one prior case is found, the bail may be withdrawn; otherwise, it will be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S.
Issues considered
- Whether anticipatory bail can be granted under Section 438 Cr.P.C. in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016
- Whether the confessional statement of Gulshan Kumar Yadav made in police custody can be treated as substantive evidence
- Effect of the 2018 amendment to the Excise Act on the concepts of deemed possession and presumed offender
