Patna High Court

Sandeep Thakur @ Sanjeev Kumar ThakurversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner, directing release upon furnishing a bail bond with two sureties.

Summary

The petitioner, Sandeep Thakur, was arrested in connection with a case registered under multiple sections of the Bharatiya Nyaya Sanhita and the Arms Act, alleging that he inflicted a grievous firearm injury on an informant. He had been in custody since 24 October 2025 and a charge‑sheet had already been filed. The petitioner applied for regular bail, claiming innocence, while the State opposed the relief. The court examined the length of custody, the filing of the charge‑sheet, and the nature of the offences. Considering that the charge‑sheet was already submitted and the petitioner had been detained for several months, the court found no compelling reason to deny bail. Consequently, the court ordered his release on a bail bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether regular bail should be granted to the petitioner despite the seriousness of the offences under the Bharatiya Nyaya Sanhita and the Arms Act
  • Whether the filing of the charge‑sheet and the period of custody justify the grant of bail
