The Court ordered provisional anticipatory bail to the petitioner, subject to bond, sureties, surrender within six weeks, and verification of his criminal antecedent.
Summary
The petitioner, Sanjiv Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 54.75 litres of liquor from a bamboo orchard adjacent to his house. He argued that the liquor was not in his conscious possession and the location did not belong to him, contending that the investigation was based on secret information without proper inquiry. The State opposed the bail. The Court, considering the submissions, granted provisional anticipatory bail conditioned on the petitioner furnishing a bail bond of Rs.5,000 with two sureties and surrendering within six weeks, subject to verification of his criminal antecedent under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S. If more than one prior case is found, the bail may be revoked; if only one, it will be confirmed.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438(2) Cr.P.C. in a case under the Bihar Prohibition and Excise (Amendment) Act, 2022.
- Whether the alleged recovery of liquor from a location not in the petitioner's possession justifies denial of bail.
