The Court granted anticipatory bail to the petitioner subject to prescribed conditions.
Summary
Arvind Kumar petitioned the Patna High Court for anticipatory bail after learning that a case had been registered against him under IPC sections 363, 366(A)/34 and POCSO Act section 8, alleging kidnapping and sexual offences involving a minor. He contended that the allegations were false, stating that the alleged victim was an adult with whom he had eloped, married, and had a child, and that the informant had misrepresented her age to give seriousness to the case. The State opposed the bail, arguing the seriousness of the offences. The Court, after considering the submissions, granted anticipatory bail to the petitioner, subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S. The order was pronounced by Justice Satyavrat Verma.
Issues considered
- Whether anticipatory bail should be granted to the petitioner in a case involving alleged kidnapping and offences under the POCSO Act.
- Whether the allegations of false implication and the victim's age are sufficient to deny bail.

4. Learned counsel for the petitioner submits that
petitioner has been falsely implicated in the instant case by the
informant. It is further submitted that petitioner and the victim
were in love and they eloped. It is next submitted that informant
only with a view to give seriousness to the case falsely alleged
that the victim is a minor when she is a major. It is also
submitted that petitioner and the victim have performed their
marriage and are living together and out of the wedlock, a child
was born. It is, thus, submitted that this perhaps explains why
the opposite party no. 2, despite receiving the notice, chooses
not to appear and contest. It is further submitted that the
petitioner and the opposite party no. 2 performed their marriage
at Arya Samaj Sewa Trust (Regd.), 106, Rajindra Market, Tis
Hazari Court, Delhi and in the said certificate of marriage, the
victim has disclosed her age as 01.01.2005.
5. Learned A.P.P. for the State opposes the prayer for
anticipatory bail of the petitioner.
6. Considering the submissions made by the learned
counsel appearing on behalf of the petitioner, let the petitioner,
