Holding
Provisional anticipatory bail is granted subject to bail bond, sureties and verification of the petitioner’s antecedent.
Summary
The petitioner, Surendra Shaw, sought anticipatory bail fearing arrest in a case under Sections 30(a), 34 and 36 of the Bihar Excise Act for alleged recovery of 560 litres of liquor from a vehicle. He argued that he was not caught in possession, was not the owner of the car, and was implicated solely on secret information, despite having five prior excise cases. The State opposed the bail. The Court, after hearing both sides, granted provisional anticipatory bail conditioned on a bail bond of Rs. 25,000 with two sureties and directed verification of the petitioner’s criminal antecedent. If the verification shows more than five prior cases, the bail will not be confirmed; if exactly five, the provisional order will be confirmed. The order was made under Section 482(2) of the BNSS.
Issues considered
- Whether the petitioner is entitled to anticipatory bail in the excise case.
- Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.
