Patna High Court

Aman Kumar @ Manjeet KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

Aman Kumar was arrested on 9 December 2025 in connection with a land‑dispute‑related incident in which he allegedly assaulted the victim with a sharp weapon and fired at him, attracting charges under multiple sections of the Bihar Negotiable Substances Act, 2023 and section 27 of the Arms Act. The petitioner sought regular bail, arguing that he has a clean antecedent, the alleged injuries were inconsistent, and the parties are close agnates. The State opposed the bail, emphasizing the seriousness of the offences. The court considered the petitioner’s lack of prior criminal record, the duration of his custody, and the familial and dispute context, and found no compelling reason to deny bail. Consequently, the court ordered his release on bail upon furnishing a bond of Rs 10,000 with two sureties.

Issues considered

  • Whether regular bail can be granted to an accused charged under sections 126(2), 115(2), 118(1), 109(1), 329(3), 352, 351(3), 3(5) of the B.N.S., 2023 and section 27 of the Arms Act.
  • Whether the petitioner’s clean antecedent, familial relationship with the victim, and the land‑dispute context justify bail despite the seriousness of the charges.
