Patna High Court

Chandan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court inclined to grant bail to the petitioner, directing the execution of a bail bond with sureties.

Summary

Chandan Kumar was arrested in connection with a case alleging that 177 litres of Nepali liquor were recovered from his motorcycle, violating Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act. The petitioner claimed he was falsely implicated, asserted that no incriminating material was found in his possession, and highlighted a lack of compliance with Section 103 of the BNSS, 2023. He had been in custody since 22 November 2025 and possessed one prior criminal antecedent. The State opposed bail, but the Court, considering the circumstances and the period of custody, decided to grant bail. The order directed the petitioner to furnish a bail bond of Rs.15,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the petitioner under the Bihar Prohibition and Excise Act in view of the alleged offences and his prior criminal antecedent.
  • Whether the non‑compliance with Section 103 of the BNSS, 2023, bars the grant of bail.
