The petition is allowed and Criminal Miscellaneous No.72776 of 2025 is restored to its original file.

Summary

Satya Narayan Singh filed an application seeking restoration of Criminal Miscellaneous No.72776 of 2025 after a peremptory order dated 14‑10‑2025 had rejected the proceeding for failure to issue a notice to the second opposite party, Niranjan Pandey, within the time fixed by the court. The petitioner argued that the failure was due to a mistake by the Advocate Clerk, not his own neglect. The court examined whether a procedural lapse caused by a clerical error could justify reinstating the dismissed proceeding. Finding merit in the petitioner's explanation, the court allowed the application and ordered that the criminal miscellaneous case be restored to its original file. Consequently, the petition was granted and the proceedings revived.
