Holding

Provisional anticipatory bail is granted subject to conditions and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Dipu Ray, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act alleging recovery of 180 litres of liquor from a hut he claims does not belong to him. He argued that the complaint was based on the testimony of a hostile chowkidar and that no liquor was seized from his possession. The State opposed the bail. The Court, after hearing both sides, granted provisional anticipatory bail conditioned on a Rs.10,000 bail bond with two sureties and directed the trial court to verify the petitioner’s criminal antecedent within six weeks. If more than two prior cases are found, the bail will not be confirmed; if only two, the provisional order will be confirmed. The order was made under Section 482(2) of the Criminal Procedure Code.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the case under Section 30(a) of the Bihar Excise Act
