Anticipatory bail was granted as the petitioner’s case was found to be analogous to a previously decided case and fell within the scope of Section 482(2) of the BNSS.
Summary
The petitioner, Danish Alam Ansari, sought anticipatory bail fearing arrest in a case (PS Dhaka Case No. 302 of 2024) involving multiple offences under the Bihar Negotiable Sale Act, 2023, including assault on medical staff and arson. He argued that he has a clean antecedent and that his case is analogous to a prior matter (Md. Arif and others) where anticipatory bail was granted by a coordinate bench on 21-11-2025. The State opposed the bail, contending the seriousness of the offences. The Court examined the FIR, the earlier order, and found the factual similarity sufficient to extend the same relief. Accordingly, the Court ordered that, if arrested or surrendered within six weeks, the petitioner be released on anticipatory bail upon furnishing a bail bond of Rs.15,000 with two sureties, subject to conditions under Section 482(2) of the BNSS. The application was allowed.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under the circumstances.
- Whether the petitioner’s case is sufficiently similar to the earlier case of Md. Arif and others to merit the same relief.
- Whether the conditions of Section 482(2) of the Bihar Negotiable Sale Act, 2023, permit the grant of anticipatory bail.
