Holding

The High Court held that the civil court lacks jurisdiction to entertain the petition under Section 145, and therefore the interim order was vacated and the trial court was directed to expedite the pending trial.

Summary

The petitioners, North Bihar Power Distribution Company Ltd., filed a criminal miscellaneous application seeking to quash an order dated 26‑09‑2013 passed by the Sessions Judge, Begusarai, under Section 135 of the Electricity Act, 2003. They contended that, pursuant to Section 145 of the Electricity Act, a civil court lacks jurisdiction to entertain a challenge to an order of an Assessing Officer or Appellate Authority. The respondents, the State of Bihar and Pushpak Kumar, opposed the petition and indicated willingness to cooperate for speedy trial disposal. The High Court, after hearing counsel, concluded that the petition was not maintainable and that the interim order in the application should be vacated. Consequently, the Court directed the trial court to expedite the pending trial in accordance with law.
