Provisional anticipatory bail was granted subject to conditions and verification of the petitioner’s antecedents.

Summary

The petitioner, Sharukh Alam, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, for the alleged recovery of 40.320 litres of liquor and the seizure of three motorcycles, one of which he owned. He contended that he had no prior criminal record, that the liquor was recovered from a location not belonging to him, and that he was unaware his friend used his vehicle in the alleged offence. The State opposed his request for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a modest bail bond and two sureties, and directed the trial court to verify the petitioner’s antecedents before confirming the bail. If any antecedent is found, the provisional bail would not be confirmed; otherwise, it would be confirmed immediately. The order was made under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances of the case
  • Whether the petitioner’s ownership of a seized vehicle suffices to implicate him in the offence

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

recovery is from a place which does not belong to the petitioner

person would use his own vehicle for committing an occurrence

and thus would create evidence against himself and hence

would get implicated. It is also submitted that the petitioner was

completely unaware that his friend would misuse his vehicle in

the manner as alleged who also fled from the spot.

                       4. Learned A.P.P. for the State opposes the prayer for
