DISPOSED

Holding

The court granted provisional anticipatory bail to the petitioner, subject to bail bonds, sureties, and verification of his criminal antecedents.

Summary

The petitioner, Mannan Lal Mahto, feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, where 15 litres of liquor were recovered from a motorcycle he owned. He argued that he was not present at the spot, had no conscious possession of the liquor, and was unaware that another person, Bhagwan Lal Mahto, misused his vehicle. The State opposed his request for anticipatory bail. The High Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.20,000 with two sureties and directed verification of the petitioner’s criminal antecedents. The order stipulated that if more than four prior cases are found, the bail would not be confirmed; if exactly four, the bail would be confirmed immediately.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether ownership of the vehicle used in the alleged offence implicates the petitioner.
  • How the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.

as such nothing was recovered from his conscious possession

and he came to be implicated based on the fact that he is owner

                       6. It is made clear that the learned trial court thereafter
