Patna High Court

Sudhama Singh @ Sudama Singh @ Sudhama SharmaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner.

Summary

The petitioner, Sudhama Singh, was implicated in a police case (No. 270 of 2025) alleging offences such as theft, assault, and criminal intimidation under various sections of the Bhartiya Nyaya Sanhita, 2023. He contended that the allegations were vague, stemmed from a land dispute, and that co‑accused persons had already been granted anticipatory bail by a coordinate bench. The petitioner argued that there was no specific charge against him and that a pending title suit highlighted the dispute. The court noted the general nature of the accusation, the bail already granted to co‑accused, and found merit in the petitioner's claim of innocence. Consequently, the court granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties if arrested within four weeks, subject to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted when the allegations against the petitioner are general and omnibus in nature
  • Whether the grant of anticipatory bail to co‑accused influences the bail decision for the petitioner
