The Court granted anticipatory bail to the petitioners, finding no specific charge against them in the FIR.
Summary
The petitioners, Dilkhush Raj and Kaushlendra Prasad, sought anticipatory bail fearing arrest in connection with Noorsarai Police Station Case No. 586 of 2025, which was registered under Sections 191(1), 190, 126(2), 115(2), 351(2) and 117(2) of the B.N.S. 2023. The FIR alleged that the accused, including the petitioners, beat an informant and Subelal Yadav, but the specific assault was attributed to co‑accused Pawan Kumar and Satyendra Yadav. The petitioners contended that no specific allegation was made against them and that the case was a retaliatory filing. The Court observed that the FIR contained only a general, omnibus allegation against the petitioners while the concrete assault charge was directed at the co‑accused. Consequently, the Court granted anticipatory bail to the petitioners, subject to a bail bond of Rs. 10,000 with two sureties and conditions under Section 482(2) of the B.N.S. 2023.
Issues considered
- Whether anticipatory bail should be granted when the FIR contains only general allegations against the petitioners and specific assault allegations are directed at other co‑accused.
