Provisional anticipatory bail was granted to the petitioner subject to bond, sureties and verification of his criminal antecedent.

Summary

The petitioner, Raju Mukhiya, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act alleging recovery of 168 litres of liquor. He argued that no liquor was found in his possession and the case was based solely on a confessional statement made by another accused in police custody, which he claimed lacked evidentiary value. He further contended that the 2018 amendment to the Excise Act had abolished the concepts of deemed possession and presumed offender, and that the investigation was mechanically based on hearsay. The State opposed the bail. The Court granted provisional anticipatory bail subject to a bond of Rs.20,000 with two sureties and directed the trial court to verify the petitioner’s criminal antecedent, noting that if more than four prior cases are found, the bail would not be confirmed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the confessional statement of another accused can form the basis for arrest in the absence of seized liquor.
  • Whether the 2018 amendment to the Bihar Excise Act eliminates the doctrines of deemed possession and presumed offender.

Subjects

  • anticipatory bail
  • excise law
  • deemed possession
  • confessional statement
  • criminal antecedent
  • provisional bail

value. It is next submitted that after amendment in the excise act

in the year 2018, the concept of deemed possession and

presumed offender has been done away with. It is also submitted

that once an accused is implicated in a case relating to excise,

the police starts implicating mechanically either at the instance

of Chowkidar, local person, confessional statement or secret

the event if it is found that petitioner has antecedent of more than

four cases then it would be presumed that petitioner, for the

purposes of seeking anticipatory bail, had concealed his
