Patna High Court

Abodh Ray @ Abodh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to bond and conditions.

Summary

Abodh Ray, accused of assaulting an informant with a lathi, danda and an iron rod, was arrested on 24 October 2025 in connection with a land‑dispute‑related incident (Piprahi P.S. Case No. 190 of 2024). The petitioner, claiming a clean antecedent, sought bail for offences under Sections 126, 115(2), 352, 109, 303(2) and 3(5) of the B.N.S., 2023. The State opposed bail, arguing the seriousness of the charges. The court noted the pending title suit and the land‑dispute background, and found no material reason to deny bail. Accordingly, the court granted bail on a Rs.10,000 bond with two sureties and imposed conditions regarding trial attendance, non‑tampering with evidence, and verification of criminal antecedents.

Issues considered

  • Whether the petitioner is entitled to bail despite the nature of the offences charged under the B.N.S., 2023.
  • Whether the land‑dispute context and pending title suit justify granting bail.
