Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to anticipatory bail subject to bond and surety conditions under Section 482(2) of the BNSS.

Summary

The petitioner, Makeshwar Yadav, sought anticipatory bail in a case registered under Section 392 of the Indian Penal Code for alleged robbery. He claimed he was falsely implicated, asserting that the informant, Amit Kumar, later became an accused after a tablet was recovered from his house, indicating a false complaint. The petitioner assured the court he would not abscond and would cooperate with the investigation. The State opposed the anticipatory bail. The court, after considering the submissions, granted anticipatory bail, directing the petitioner to furnish bail bonds of Rs.10,000 each with two sureties, subject to conditions under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the BNSS in a case of alleged false implication under Section 392 IPC.
  • Whether the petitioner is likely to abscond or tamper with evidence.

petitioner has been falsely implicated in the instant case during

the instant FIR, namely, Amit Kumar was later made an accused

off the money, tab and mobile of the company for which he was

working. It is submitted that petitioner will not abscond rather
