Holding

Provisional anticipatory bail is granted subject to bail bond, sureties, and verification of the petitioner’s criminal antecedent.

Summary

Vikash Bhagat applied for anticipatory bail after being implicated in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 for alleged recovery of 3.24 litres of liquor. He argued that he was not arrested at the spot, the liquor was recovered from a place not belonging to him, and that the investigation was mechanically based on a local informant’s tip. The State opposed the bail. The Court granted provisional anticipatory bail, requiring a bail bond of Rs.10,000 with two sureties and subject to verification of his criminal antecedent. If the verification shows more than two prior cases, the bail will not be confirmed; if only two, it will be confirmed immediately.

Issues considered

  • Whether anticipatory bail can be granted in a case under the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the absence of arrest and lack of possession of the alleged liquor affect the grant of anticipatory bail.
  • Whether the petitioner’s prior criminal antecedent influences the confirmation of anticipatory bail.
