Provisional anticipatory bail is granted subject to bond, sureties and verification of the petitioner’s antecedent.

Summary

The petitioner, Sonu Kumar Sah, sought anticipatory bail fearing arrest in a case under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2022, where liquor was allegedly recovered from his orchard and a car. He argued that he was not arrested on the spot, no liquor was found in his possession, he does not own the car, and the case was based solely on secret information without proper investigation. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.25,000 with two sureties, subject to verification of the petitioner’s criminal antecedent. If the verification shows more than five prior cases, the bail will not be confirmed; if only five, it will be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C. in view of the alleged offences under the Bihar Prohibition and Excise (Amendment) Act, 2022 and his criminal antecedent.
