The court dismissed Roshan Kumar's anticipatory bail application as withdrawn and granted anticipatory bail to Sabita Devi subject to statutory conditions.

Summary

The petitioners, Roshan Kumar and Sabita Devi, sought anticipatory bail in a criminal case (PS Case No. 444 of 2025) involving offences under Sections 103(1) and 3(5) of the Bihar Narcotic Substances Act, 2023. Roshan Kumar withdrew his application, which the court dismissed as withdrawn. Sabita Devi, a married woman and sister of the deceased victim, claimed she was falsely implicated due to a family property dispute and that no specific allegation of assault was made against her. The State and the informant opposed her bail, but could not refute her contentions. Considering her gender, marital status, and lack of direct allegation, the court granted her anticipatory bail subject to a Rs.10,000 bond, two sureties, and conditions under Sections 438(2) of the Cr.P.C. and 482(2) of the B.N.S.S.

Issues considered

  • Whether the anticipatory bail application of Roshan Kumar should be withdrawn.
  • Whether anticipatory bail should be granted to Sabita Devi despite the allegations under the B.N.S. Act.
