Patna High Court

Rinku Kumar @ Rikku KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The High Court allowed the pre‑arrest bail, directing release on the same terms as the earlier order despite the earlier inaccurate statement.

Summary

The petitioner, Rinku Kumar, applied for pre‑arrest bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act. Earlier, the High Court had granted bail but the bond was rejected because the petitioner’s statement about his criminal antecedents was found to be inaccurate. The petitioner renewed the bail application, explaining that the error was due to lack of knowledge of his proxy. The Court, noting that it had previously released the petitioner, ordered that he be released on bail on the same terms as the earlier order, subject to a bond of Rs.10,000 and two sureties of equal amount. Consequently, the bail application was allowed and the matter disposed.

Issues considered

  • What is the appropriateness of granting pre‑arrest bail when the petitioner’s earlier statement on criminal antecedents was incorrect?
  • Whether the conditions of the earlier bail order can be reiterated for the renewed application.
