BAIL GRANTED

Holding

The court allowed the anticipatory bail application, granting bail to the petitioners subject to conditions under Section 482(2) of the B.N.S.

Summary

The petitioners, a group of seven individuals including several women, applied for anticipatory bail after being implicated in a case arising from a disturbance at a nursing home following the death of a patient named Puja during delivery. They claimed they had clean antecedents and were falsely implicated based on general allegations, asserting that the altercation was a result of emotional distress and a dispute over money with the nursing staff. The State opposed the bail, citing offences under multiple sections of the Bihar Negotiable (B.N.S.) Act. The court considered the petitioners' clean record, the nature of the alleged incident, and the conditions under Section 482(2) of the B.N.S. The court granted anticipatory bail, directing the petitioners to furnish bail bonds of Rs.10,000 each with two sureties, subject to the stipulated conditions. The application was allowed, and the petitioners were released on anticipatory bail.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the B.N.S.
  • Whether the allegations against the petitioners constitute a false or general omnibus accusation
  • Whether the petitioners pose a risk of fleeing, tampering with evidence, or committing further offences
