Anticipatory bail was granted to petitioners 2 and 3 but denied to petitioner 1, Sanoj Kumar Singh.

Summary

The petitioners, Sanoj Kumar Singh, Raj Kumar Singh, and Randhir Kumar Singh, sought anticipatory bail fearing arrest in a case registered under multiple sections of the Bihar Negotiable Statutes (BNS) relating to assault, grievous hurt, and other offences arising from a land dispute. They claimed to have clean antecedents and alleged that the informant falsely implicated them, asserting that the FIR exaggerated the involvement of petitioners 2 and 3. The State opposed bail, emphasizing that petitioner 1, Sanoj, allegedly inflicted grievous injuries with a cudgel. The court, after considering the submissions, granted anticipatory bail to petitioners 2 and 3 subject to bond and surety conditions, but refused bail to petitioner 1. The decision was based on the seriousness of the alleged assault by petitioner 1 and the lack of sufficient justification for extending bail to him.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the BNSS.
  • Whether the allegations against petitioners 2 and 3 are sufficient to deny anticipatory bail.
  • Whether the alleged false implication and clean antecedent of the petitioners merit anticipatory bail.

                                       ORAL ORDER

2 07-04-2026 Heard learned counsel for the petitioners and

                   learned A.P.P. for the State.

                                   2. The petitioners apprehend their arrest in a case

registered for the offences punishable under Sections 191(2),

                   191(3), 190, 115(2), 118, 303(2), 109, 352 and 351(2) of the

                   BNS.

                                   3. Learned counsel for the petitioners submits that

petitioners are persons with clean antecedent and the informant

alleges that on 03.12.2025, he has gone on his land when

accused persons including the petitioners came and started

claiming the land as their, on objection, Sanoj (petitioner no. 1)

assaulted him by kudal causing injury on head and Randhir

dashed him on the ground and when his brother Rajesh and

Muntun came to save him, when all the accused assaulted them

and Vikash took out Rs.5,000/- from the informant.

                          4. Learned counsel for the petitioners submits that

petitioners have been falsely implicated in the instant case by

the informant, it is next submitted that from perusal of the

allegation as alleged in the FIR it would manifest that on

account of dispute relating to land, the occurrence is alleged to

have taken place, it is also submitted that side of the informant

has also assaulted the side of the petitioner and Sanoj suffered

two injuries on head which have been opined to be grievous by

the doctor. It is fairly submitted that in the instant FIR, it is

alleged that Sanoj assaulted the informant by kudal causing

injury on head but then no specific allegation is alleged against

petitioner nos. 2 and the allegation against petitioner no. 3 is

          exaggerated.

                          5. Learned A.P.P. for the State opposes the prayer

for anticipatory bail of the petitioners and submits that petitioner

no. 1 is alleged to have assaulted the informant by kudal causing

injury on head and the same has been opined to be grievous in

nature. It is also submitted that no doubt it has been submitted

that even Sanoj suffered two grievous injuries on head but then

that in itself cannot be a ground for granting the privilege of

                     anticipatory bail to Sanoj.

                                  6. Considering the submissions made by the learned

counsel for the parties, the petitioner nos. 2 and 3, in the event

of their arrest or surrender within a period of six weeks from

today, be released on anticipatory bail on furnishing bail bonds

of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties

of the like amount each to the satisfaction of the learned trial

with Bhagwanpur P.S. Case No. 364 of 2025 subject to the

conditions as laid down under Section 482 (2) of the BNSS.

                                  7. The court is not inclined to extend the privilege of

anticipatory bail to petitioner no. 1, namely, Sanoj Kumar Singh.
